ANY DISCHARGE PORT CHANGE AFTER THEPERFORMING VESSEL SAILS FROM THE PORT OF VLADIVOSTOK IS NOT ACCEPTED UNLESS IT IS SPECIFICALLY AGREED BY THE SELLER IN WRITING WITH THE RESPECTIVE COSTS REIMBURSEMENT PROCEDURE. IN CASE THE DISCHARGE OF THE PERFORMING VESSEL AT THE NOMINATED DISPORT IS DELAYED MORE THAN FIVE CALENDAR DAYS (120HOURS) FROM THE N.O.R. OF THE VESSEL, THE BUYER SHOULD PAY TO THE SELLER A PENALTY OF USD 25’000 PDPR FOR THE PERIOD STARTING FROM N.O.R. PLUS 120HOURS UNTILL THE ACTUAL TIME OF THE DISCHARGE COMMENCEMENT (THE TIME LOS TDUE TO BAD WEATHER(CLEARLY STATED IN THE TIME SHEET) WILL NOT BE CONSIDERED AS TIME ON SUCH DELAY.IT IS CLEAR AND UNDERSTOOD THAT MONIES DUE UNDER THIS WAITING TIME PENALTY CLAUSE ARE ABOVE AND BEYOND, AND SEPARATE FROM ANY DAMAGES ALSO RECOVERABLE UNDER CLAUSE 9 ‘DEMURRAGE’ OF THIS CONTRACT,ANDCALCULATED INDEPENDENTLY OF, AND WITHOUT PEJUDICE TO, THE NORMAL COUNTING OFLAYTIME, OR DEMURRAGE IF THE VESSEL IS ON DEMURRAGE, UNDER THE CONTRACTUALLAYTIME AND DEMURRAGE CLAUSES OF THIS CONTRACT.
